Drug Possession, Forgery Charges for Darien 20 Year-Old

A police officer who encountered three young Darien men twice in one night got two different answers from one of them when he asked for their names, then the officer found drugs and a phoney driver's license while arresting and searching him.

That man, Scott Waters, 20, of Walmsley Road, had been arrested two years before in an unrelated case in Darien, when he was charged with assaulting a Darien High School student on the night of a party.

Darien police gave this account (an accusation not proven in court) of the recent incident:

Late in the evening on Friday, Aug. 3, the officer, in a patrol car traveling south on Noroton Avenue, saw three young men run across the street near its intersection with Park Place.

Because of the recent burglaries in the area, the officer stopped them, asked them what they were doing and asked them for their names. Each young man gave his name and provided the officer with identification. Waters provided a "generic" false name.

A little while later, the officer, still on patrol, came across the same group near the intersection of Hollow Tree Ridge Road and Hillside Avenue. He again asked them their names, and as the officer spoke with them, one of the young men happened to turn to Waters and say "Hey, Scott ..."

The officer remembered that that wasn't the name the young man had given on the first encounter. He again asked Waters to state his name and Waters gave his correct name.

The officer also noticed the odor of both alcohol and marijuana coming from Waters, and on further questioning, Waters admitted he had used both. When asked if he had anything illegal in his possession, Waters said he didn't.

When Waters was asked to empty his pockets, the officer examined Waters' wallet, in which he felt a cylindrical object. A small amount of marijuana was also came out of Waters' pocket, along with a clear glass vial containing two small pills, which the officer identified as oxycodone.

Inside the wallet was a small, cut pen tube containing blue powder which looked like the pills. The officer reported that tubes like that are commonly used in snorting narcotics.

Two photo IDs were also in the wallet. One belonged to someone in Massachusetts. The other was a phony Connecticut driver's license.

Waters was charged with obtaining drugs illegally, possession of drug paraphernalia, possession of less than four ounces of marijuana, interfering with an officer, second-degree forgery and possession of fake identification. He was later released on a $250 bond and is scheduled to appear Aug. 15 in state Superior Court in Stamford.
